At The Nirvana Stays, we understand that travel plans may need to change unexpectedly. We are committed to providing fair and transparent cancellation and refund terms in accordance with applicable Indian laws and industry standards.


1. General Policy

This policy applies to all direct bookings made via our official website, phone, or email. If your booking was made through an online travel agency (OTA) or third party, their respective cancellation policies will apply.


2. Cancellation Terms

2.1 Individual Room Bookings

  • Free Cancellation: Cancellations made at least 48 hours before the scheduled check-in date are eligible for a 100% refund.

  • Late Cancellation: Cancellations made within 48 hours of the check-in date will be charged one night’s stay.

  • No-show: Guests who do not check-in without prior cancellation will be charged for the entire stay, and no refund will be issued.

2.2 Group Bookings (5 rooms or more)

  • Free Cancellation: Up to 7 days prior to the check-in date – 100% refund.

  • Cancellation within 7 days: 25% of the total booking amount will be charged.

  • Cancellation within 48 hours: 50% of the total booking amount will be charged.

  • No-show: 100% of the total booking amount will be charged.


3. Peak Season & Festive Periods

During peak travel periods (e.g., summer vacations, long weekends, Diwali, Christmas, New Year), the cancellation window may extend to 7 days or more. Specific terms will be communicated at the time of booking.


4. Early Check-Outs

In case of early departure, one additional night’s charge or the remaining stay amount, whichever is lower, may be retained. Refund decisions for shortened stays are subject to hotel management discretion.


5. Refund Process

  • Refunds will be initiated within 7 to 10 business days of cancellation approval.

  • Refunds will be processed to the original payment method only.

  • If booked via third-party platforms, refunds will be governed by their terms and processing timelines.


6. Non-Refundable Offers

Promotional bookings or discounted packages labeled "Non-Refundable" are not eligible for refunds under any circumstances, including cancellations or no-shows.


7. Force Majeure Events

In case of cancellation due to natural calamities, road blockages, pandemic lockdowns, strikes, or government restrictions, we may offer:

  • Full refund, or

  • Credit voucher valid for a future stay (subject to availability).
    Such cases will be reviewed individually by hotel management.


8. Modifications

  • Booking modifications (date or guest details) are allowed up to 48 hours prior to check-in and are subject to availability.

  • Any tariff differences due to change in season, room type, or number of guests will be chargeable.


9. Legal Jurisdiction

This policy is governed under Indian law. Any disputes arising will be subject to the exclusive jurisdiction of the courts in Nainital, Uttarakhand.
